This English translation is provided for convenience. The Polish version is the legally binding text.
Preliminary Provisions
These terms and conditions (hereinafter: the “Terms”) have been issued pursuant to the provisions of the Act of 20 March 2009 on the Security of Mass Events, consolidated text, Journal of Laws (Dz.U.) of 2023, item 616 (hereinafter the “Act on Mass Event Security”), pursuant to the Act of 22 August 1997 on the Protection of Persons and Property, consolidated text, Dz.U. of 2021, item 1995 (hereinafter the “Act on the Protection of Persons and Property”), and pursuant to the provisions of the Civil Code (Kodeks Cywilny).
The purpose of the Terms is to ensure the safety of persons and property at the Festival by setting out the rules of entry, conduct, and use of the Festival Grounds — including in particular the Organiser's Grounds — and the infrastructure located thereon, and by setting out the conditions of participation in the Festival through the regulation of the rights and obligations of Attendees holding a Ticket to the Festival.
The Terms are addressed to all persons who, during the Festival, will be present on the Organiser's Grounds, including in particular on the Festival Grounds, regardless of whether the given person is an Attendee. Every person present on the Organiser's Grounds, including on the Festival Grounds, during the Festival is obliged to comply with the provisions of these Terms.

Rules on the Purchase, Use, and Return of Tickets
Tickets are sold exclusively through authorised Ticket Partners and via the website www.clout.pl. Before purchasing a Ticket to the Festival, it is necessary to read and accept the terms and conditions of the authorised Ticket Partners, in particular the Ticket Partner's Ticket Purchase Terms.
Tickets may only be sold at the price shown on the Ticket Partner's website and on the Organiser's website at www.clout.pl. The Ticket Partner may add a service fee for selling the Ticket through its platform. The amount of the service fee is transparently indicated on the Ticket Partner's platform.
A Ticket is considered valid, i.e. entitling the holder to enter the Festival, if it is original and acquired in accordance with the provisions of these Terms and the terms and conditions of the authorised Ticket Partner, in particular the Ticket Purchase Terms. A Ticket acquired in breach of these Terms or the Ticket Partner's Ticket Purchase Terms is invalid and cannot constitute grounds for participation in the Festival. If a Ticket proves invalid during its verification, the holder of the invalid Ticket will not receive a Wristband and will not be admitted to the Festival Grounds, and in the case of a holder of an invalid Ticket who is already present on the Festival Grounds, that person will be required to leave the Festival Grounds immediately. The Organiser reserves that the purchase of a valid Ticket entitling the holder to enter the Festival is possible only from an authorised Ticket Partner. Purchasing a Ticket from another, unofficial source will result in refusal to exchange the Ticket for a Wristband and refusal of entry to the Festival.
A Ticket is subject to verification and exchange for a Wristband upon the authorised holder's first entry with a valid Ticket onto the Festival Grounds. Verification of the Ticket consists of checking the Ticket's validity by scanning the QR code or entering the Ticket ID. In the case of named tickets, before entry onto the Festival Grounds, verification may be carried out of the compliance of the personal data provided on the Ticket with the personal data contained in the identity document of the Ticket holder.
If a discrepancy is identified between the personal data provided on a named Ticket and the personal data contained in the identity document of the Ticket holder, or if the Ticket holder refuses to undergo verification of personal data, the entity designated by the Organiser to verify Tickets, or the Festival Organiser, may refuse the Ticket holder participation in the Festival. Only upon successful verification is the Ticket exchanged for a Wristband entitling the holder to enter the Festival Grounds.
The unique QR code on the Ticket and the ID (unique code) of the Ticket entitle the holder to a single entry onto the Festival Grounds. If the Festival Grounds are left, re-entry is possible only upon presentation of the Wristband or purchase of another Ticket. The Organiser warns that, if the Ticket is made available (in any form) to a third party, that Ticket may be used by that third party, which will consequently result in the person who made the Ticket available being refused the exchange of the Ticket for a Wristband and refused entry to the Festival.
The Organiser allows for changes to the personal data (first name and surname) on a named Ticket. Changes to the data on the Ticket are regulated in the Ticket Partner's Ticket Purchase Terms.
It is prohibited to publicly offer the transfer of ownership of Tickets, including as a prize in a competition, lottery, or promotion, or other actions of a similar nature, even free of charge, without the prior express consent of the Organiser, granted in writing.
In the event of resale, attempted resale, an attempt at or the commission of any forgery of a Ticket, including the copying or attempted copying of a Ticket or the Ticket's QR code or Ticket ID, or other actions of a similar nature, the Ticket will not successfully pass Ticket verification or may be deemed invalid by the Organiser, which will result in refusal of entry to the Festival, without the right to a refund of the Ticket price.
The Organiser shall not be liable to the Ticket holder in the event of a refusal to issue a Wristband or a refusal of entry onto the Festival Grounds and participation in the Festival, where the Ticket is invalid due to its purchase in breach of these Terms or the Ticket Partner's Ticket Purchase Terms, or in the event of the acquisition, use, or attempted use of a forged or altered Ticket and/or QR code or Ticket ID.
The Organiser advises that, pursuant to Article 133 of the Act of 20 May 1971, the Code of Petty Offences (Dz.U.2023.2119, consolidated text), acquiring Tickets for the purpose of resale at a profit, and selling at a profit tickets to artistic, entertainment, or sporting events, is punishable by arrest, restriction of liberty, or a fine. An attempt to commit, as well as incitement to and aiding and abetting, such acts are also punishable.
Where a person with a disability wishes to participate in the Festival together with a supporting person, each of these persons is required to hold their own Ticket. Information necessary for the participation of persons with disabilities in the Festival, in particular information on the designated zones for persons with disabilities, will be provided no later than 7 days before the start of the Festival on the Organiser's website.
Entry to the Festival
The Organiser advises that, due to the significant number of Attendees, the need to exchange Tickets for Wristbands, and the necessary control and security measures applied at the entrance to the Festival, Attendees are required to arrive at the Festival venue with adequate advance notice. The Organiser recommends arriving at the Festival venue at least 2 hours before its start.
Admission to the Festival Grounds is granted to a person holding an identity document and a valid Ticket, which, upon first entry to the Festival Grounds, will be verified and, if verification is successful, exchanged for a Wristband. Each entry to the Festival Grounds is permitted only to an Attendee wearing an undamaged Wristband permanently fastened to the wrist.
The Wristband may not be transferred to another person. Damage to or tearing of the Wristband renders it invalid and prevents the holder from remaining on, or entering, the Festival Grounds.
A Minor who, on the day of participation in the Festival, has reached the age of 16 (a person born on or before 11 July 2010), may take part in the Festival with the written consent of their legal representative, granted in accordance with the form template referred to in Section 3.6 of these Terms.
A Minor who, on the day of participation in the Festival, has not yet reached the age of 16 (a person born after 11 July 2010), may take part in the Festival only under the supervision of an adult who is the legal representative or a person designated by the legal representative in accordance with the form template referred to in Section 3.6 of these Terms.
The consent of the legal representative must be given using the form made available by the Organiser on the website www.clout.pl and at the following link: [CONSENT FORM LINK]. The Minor must present the representative's consent when exchanging the Ticket for a Wristband. The absence of the representative's consent prevents the exchange of the Ticket for a Wristband, and thus prevents admission to the Festival.
Children are entitled to participate in the Festival free of charge, under the continuous supervision of their legal representative, without the need to hold a Ticket. Legal guardians of Children are required to have, upon entry to the Festival Grounds or to a selected Zone, a document confirming the Child's age (for example, an identity card, passport, or the Child's health record booklet).
The requirement to hold a document confirming age also applies to Minors. The absence of a document confirming age is equivalent to a requirement that the person participate in the Festival only under the supervision of an adult who is the legal representative or a person designated by the legal representative in accordance with the form template referred to in Section 3.6 of these Terms.
One adult may supervise a maximum of three Minors participating in the Festival.
Pursuant to Article 22.1 of the Act on Mass Event Security, the Organiser is obliged to refuse admission to the Festival Grounds to:
- persons against whom a ruling has been issued banning them from attending mass events or obliging them to refrain from being present at venues where mass events are held, as well as persons against whom a foreign or club ban has been issued within the meaning of the Act on Mass Event Security;
- a person refusing to submit to actions carried out by the Order Service and Information Service aimed at checking and confirming a person's entitlement to participate in the Festival, or a person refusing to be identified by the Order Service or Information Service for the purpose of establishing their identity or age;
- a person bringing, or in respect of whom there is a suspicion of bringing, onto the Festival Grounds weapons or other dangerous items, explosive materials, pyrotechnic articles, fire-hazardous materials, alcoholic beverages, narcotic drugs, or psychotropic substances, if such person refuses to allow the Order Service or Information Service to inspect the contents of their luggage and clothing;
- a person visibly under the influence of alcohol, narcotic drugs, psychotropic substances, or other substances with a similar effect;
- a person behaving aggressively, provocatively, or otherwise creating a threat to safety or public order.
The Organiser may refuse admission to, and presence at, the Festival to persons:
- not holding a Wristband, or holding a Wristband improperly fastened to the wrist, or holding a damaged Wristband, or who obtained their Wristband from another person;
- not holding an identity document, refusing to present it, or whose details on the identity document do not match the details on the Ticket;
- holding an invalid Ticket, i.e. in particular a forged Ticket or one acquired from an unofficial source, acquired in breach of these Terms or of the Ticket Partner's Ticket Purchase Terms, or holding a Ticket with an incorrect or damaged QR code or Ticket ID;
- wearing clothing, accessories, or ornaments that may pose a potential threat to the health and life of Festival Attendees and other persons present on the Festival Grounds, such as footwear with metal tips, studs, and the like;
- whose outward appearance prevents their identification or raises reasonable concerns as to their physical or mental state of health;
- possessing plastic, glass, or metal containers or cans, or other items that may pose a potential threat to the health and life of Attendees and other persons present on the Festival Grounds, subject to the containers indicated in Section 3.13 of these Terms.
The assessment of items in an Attendee's possession and their classification as dangerous is the responsibility of:
- the Order Service — within the part of the Festival Grounds constituting the mass event site;
- Security Staff — within the remainder of the Festival Grounds.
The Organiser permits Attendees to bring closed plastic bottles filled with water with a capacity not exceeding 0.5 litre, excluding glass bottles.
If the Organiser has available space designated for the storage of Attendees' belongings, an Attendee may leave belongings for safekeeping at a location indicated by the Organiser (Deposit). The rules for storing items in the Deposit will be governed by separate terms, with which the Attendee is obliged to familiarise themselves before handing over items to the Deposit.
The Organiser is not liable for items left by Attendees or other persons present on the Festival Grounds outside of the Deposit.
A fee is charged for accepting items for storage (Deposit).
If an Attendee wishes to take part or continue taking part in the Festival, storage is mandatory for items indicated in these Terms as prohibited from being brought onto the Festival Grounds. The Organiser does not accept dangerous items into the Deposit.
Only authorised persons may enter particular Zones, in particular those holding an appropriate Wristband, an appropriate Technical Identifier, or an appropriate Official Identifier, or another document confirming the right of entry to a given Zone. The presence of an unauthorised person in a Zone is prohibited, and such a person may be removed from the Festival Grounds by the Order Service, Security Staff, or the Organiser, with a simultaneous refusal of further admission to, and participation in, the Festival, regardless of whether they hold a valid Ticket or Wristband.
Festival Sponsors may designate additional Zones within the part of the Festival Grounds made available to them, to which admission may be governed by separate rules established by such sponsor.
In the event of the Wristband being torn off or damaged (on the Festival Grounds or within a given Zone), the Attendee is obliged to immediately report to Security Staff at the entrance gate to the Festival Grounds, or to a CLOUT Festival information point designated by the Organiser, together with the damaged Wristband, in order to exchange the Wristband for a new one. Only Wristbands damaged on the Festival Grounds or within a Zone are subject to exchange. For organisational reasons, the Attendee must have at least 50% of the damaged Wristband in order for it to be exchanged. Unauthorised departure from the Festival Grounds or a Zone with a damaged or torn Wristband, without prior notification of Security Staff, is deemed equivalent to relinquishing participation in the Festival on the basis of the held Wristband.
If a given Attendee needs to remove the Wristband from their wrist before the next day of the Festival — e.g. due to work performed by the Attendee — the Attendee is obliged to report this to the Organiser before leaving the Festival Grounds. The Attendee will be entitled to enter the Festival Grounds on the following day and receive a new Wristband only upon return of the previous Wristband and after verification that their identity matches that indicated in the report, on the basis of the identity document or other document presented enabling verification of identity.
The Attendee makes the report referred to above at the information point located in front of each entrance to the Festival Grounds, or at the CLOUT Festival information point on the Festival Grounds. The report should be made before the first entry to the Festival Grounds, or at the latest before the Attendee leaves the Festival Grounds, and the Attendee is obliged to present an undamaged Wristband fastened to the wrist and an identity document.
The Attendee collects the new Wristband at the same point where the report was made. This procedure does not apply to Wristbands removed independently without a prior report.
The Organiser advises that an Attendee or other person present on the Festival Grounds will be continuously present in an area of loud sounds capable of causing hearing damage. During the Festival, strobe lights and other light, sound, and pyrotechnic effects will be used, which may negatively affect the wellbeing or health of certain Attendees. Attendees or other persons present on the Festival Grounds who are aware of having contraindications to exposure to such stimuli should exercise particular caution during the Festival or refrain from taking part in it. The Organiser is not able to provide such Attendees or other persons present on the Festival Grounds with protection against such stimuli. In the case of Children or Minors present on the Festival Grounds, the guardian is obliged to take the above circumstances into account and, where appropriate, implement suitable measures to ensure the safety and comfort of the Children or Minors in their care while on the Festival Grounds.
An Attendee is not entitled to enter the stages, their backstage areas, or the premises of the Order Service or Information Service.
Organisational and Order Rules

An Attendee found to be unlawfully destroying or removing property from the Organiser's Grounds may be required to leave the Organiser's Grounds without the possibility of participating in the Festival and without a refund of the Ticket price. Members of the Order Service and Information Service, as well as Security Staff, may be equipped with handheld metal detectors, direct coercion measures, and other necessary and legally permitted items enabling them to perform their duties arising from applicable law and these Terms, as well as personal protective equipment.
Persons authorised by the Organiser to verify a given person's entitlement to enter the Festival Grounds undertake the following actions:
- verifying whether a person applying for first-time admission to the Festival Grounds holds a valid Ticket;
- verifying whether a person holding a valid Ticket has an identity document;
- checking whether the personal data on the Ticket matches the personal data on the identity document;
- verifying the age of a person applying for first-time admission to the Festival Grounds by checking a document confirming their age, in cases of doubt as to such person's age, and verifying the documents listed in these Terms as required for the participation of a Child or Minor in the Festival;
- in the case of Festival Attendees who have exchanged their Ticket for a Wristband — verifying that they hold a correct Wristband;
- in the case of persons for whom a Technical Identifier is required — verifying whether that person holds a valid Technical Identifier.
If, during the inspection of luggage or clothing, items are found whose carrying and possession at the Festival are prohibited, a member of the Order Service may refuse admission to the Festival Grounds and participation in the Festival to the person in whose possession such items were found, or may require that person to leave the Festival Grounds. To the extent permitted by the Act on the Protection of Persons and Property, the same powers are vested in Security Staff.
If, during the inspection of the luggage or clothing of a person wishing to enter the Festival Grounds, or of a person present on the Festival Grounds, weapons or other dangerous items, alcoholic beverages, explosives, pyrotechnic and fire-hazardous materials, or narcotic or psychotropic substances are found, a member of the Order Service or Information Service, or a member of the Security Staff, shall apprehend the person in whose inspected luggage or clothing such items were found and, after confiscating them, shall draw up a report of that action, and shall then hand that person over to the Police together with the confiscated items. The foregoing does not apply to medicines in their original, unopened packaging. In the case of prescription medicines, an appropriate medical certificate or a filled prescription for the given medicine must be held.
It is prohibited to conduct, without the Organiser's authorisation granted in writing, any commercial or other profit-making activity, as well as advertising and promotional activity, on the Festival Grounds or on any other part of the Organiser's Grounds.
The Organiser designates the following Zones:
- technical and social support facilities;
- mass event zone;
- VIP Zone;
- Club Zone;
- main entrance;
- fixed security checkpoints staffed by security services;
- accreditation area;
- technical parking.
The catering zone is a separate, enclosed zone in which catering services are provided and alcoholic beverages are sold. This zone is excluded from the mass event area, and alcohol purchased there may be consumed only within it.
The Organiser reserves that sales conducted on the Festival Grounds, including sales within the catering zone, will be carried out exclusively by way of cashless payment transactions.
The sale, serving, and consumption of alcoholic beverages take place exclusively within catering zones and may be conducted only by entities holding a licence to sell alcoholic beverages. The sale or serving of alcoholic beverages is permitted only to Festival Attendees who are adults. It is prohibited to sell or serve alcoholic beverages to Festival service staff or to members of the Order Service and Information Service.
During the Festival, the Organiser, Festival Attendees, contractors and persons working on the preparation and staging of the Festival, and other persons present on the Festival Grounds, undertake to comply with the provisions of the Act on Upbringing in Sobriety and Counteracting Alcoholism.
The Organiser ensures fire safety by guaranteeing that:
- Festival service staff, the Order Service and Information Service, Security Staff, and the Organiser know the location of hand-held firefighting equipment and hydrants, as well as the procedures to be followed in the event of a fire;
- the Order Service and Information Service, as well as Security Staff, must be trained in evacuation procedures, methods of alerting the fire brigade, the rules for using hand-held firefighting equipment, and the provision of first aid.
Festival Attendees are strictly obliged to comply with the instructions and directions of Festival service staff, members of the Order Service and Information Service, and Security Staff issued for the purpose of maintaining fire safety.
Recording of the Festival
Pursuant to the Act on Mass Event Security and within the scope determined by that act and its implementing regulations, the Organiser is entitled to record the course of the Festival, in particular the conduct of Festival Attendees and other persons participating in the Festival, by means of image- and sound-recording devices.
Materials gathered during the recording of the course of the Festival that may constitute evidence enabling the initiation of criminal proceedings or proceedings concerning petty offences, or evidence that may be relevant to such pending proceedings, shall be promptly transmitted by the Organiser to the public prosecutor competent for the place where the Festival is held or to the territorially competent Police commander, where necessary together with a motion to initiate criminal proceedings or a motion for punishment, unless the Organiser itself reports the offence or files a motion for punishment in petty-offence matters. Materials gathered during the recording of the course of the Festival that do not contain evidence enabling the initiation of criminal proceedings or proceedings concerning petty offences, or evidence relevant to such pending proceedings, shall be stored by the Organiser after the conclusion of the Festival for a period of at least 30 days but no longer than 90 days, and shall then be destroyed by a commission.
In order to ensure the safety of persons and property in the Zones and on the remaining part of the Organiser's Grounds, to the extent justified by the achievement of that purpose, the Organiser is entitled to record the course of the Festival by means of image- and sound-recording devices, in particular the conduct of persons and other events in the Zones and on the remaining part of the Organiser's Grounds.
In the cases specified above, the controller of personal data is the Organiser, and the data are processed in accordance with the Privacy Policy.
Subject to applicable laws and these Terms, the Organiser is entitled to record the course of the Festival for documentation purposes and for commercial purposes, including the promotion of the Organiser, the Festival, and partners, in particular the Ticket Partner and sponsors. The Organiser further advises that, pursuant to Article 81(2) of the Act on Copyright and Related Rights, consent for the dissemination of a person's image is not required where the dissemination concerns the image of a person constituting merely a detail of a wider whole, such as an assembly, a landscape, or a public event.
Cancellation, Change of Date or Venue of the Festival
Decisions regarding the cancellation of the Festival, the change of the date or venue of the Festival, and the refund of amounts paid by Ticket purchasers, i.e. the Ticket price together with the service fee collected, are made by the Organiser, on the terms set out in these Terms and on the basis of applicable law and in accordance with the Ticket Partner's Ticket Purchase Terms.
In the event of cancellation of the Festival or a change of its date or venue, the Organiser shall promptly inform of that fact by e-mail sent to the addresses provided during the process of purchasing Tickets on the Ticket Partner's website, on the Organiser's website, and on social media.
A Ticket refund is possible in the event of cancellation of the Festival or a change of its date or venue. In the event of cancellation of the Festival, the Ticket price together with the service fee collected shall be refunded to the Attendee in accordance with the provisions of these Terms. In the event of a change of the date or venue of the Festival, the Attendee may apply to the Organiser for a refund of the Ticket price together with the service fee collected.
Programme changes to the Festival caused by, e.g., logistical or technical difficulties, changes in the line-up or programme of the Festival in which several performers take part, changes to supporting performances, or changes to the gate-opening time before the start of the Festival, do not entitle Ticket purchasers to a refund of Tickets or to demand a refund of the Ticket price.
In the event of a change of the date or venue of the Festival, the Ticket purchaser may choose either to keep the Ticket held and take part in the Festival on the new date or at the new venue, or to return the Ticket and receive a refund of the Ticket price paid together with the service fee collected. The Organiser shall inform the Ticket holder, by e-mail sent to the address provided when purchasing the Ticket, of how one of these options may be chosen.
If the Ticket purchaser chooses to give up the Ticket and to obtain a refund of the Ticket price paid together with the service fee collected, the refund shall be made within 14 days of receipt by the Organiser or the Ticket Partner of the request for a Ticket refund.
If, in connection with a change of the date or venue of the Festival, the Ticket purchaser decides to keep the purchased Ticket and take part in the Festival on the new date or at the new venue, that Ticket remains valid regardless of any changes to Festival ticket prices for the new date or venue, and the purchaser or authorised holder of the Ticket need not take any additional action in this respect.
If, in the event of a change of the date or venue of the Festival, the Ticket purchaser fails to choose any of the options listed in point 6.5 of these Terms within the period specified by the Organiser, it shall be deemed that the Ticket purchaser has decided to take part in the Festival on the new date or at the new venue.
A Ticket refund is possible only through the same channel used for its purchase, i.e. via the Ticket Partner from whom the Ticket purchaser bought the Ticket.
The Organiser bears no liability for defects, including the authenticity, of Tickets purchased other than through the Ticket Partner. The Organiser is not obliged to ensure that the purchaser or holder of such a Ticket may take part in the Festival, nor to refund the Ticket price or exchange the Ticket, in circumstances entitling to a refund or exchange as described in these Terms.
An unused Ticket does not entitle the holder to a refund of the Ticket price or of the service fee, nor to an exchange of Tickets, except in the case of cancellation of the Festival or a change of the date or venue of the Festival, unless generally applicable law or these Terms provide otherwise.
A person purchasing a Ticket is obliged to read these Terms and the Ticket Partner's Ticket Purchase Terms. Purchase of a Ticket is equivalent to acceptance of these Terms and of the Ticket Partner's Ticket Purchase Terms.
Complaints
The Organiser considers complaints concerning the organisation, conduct, and course of the Festival, as the entity solely responsible for organising the Festival.
Complaints concerning the purchase of Tickets are considered by the Ticket Partner in accordance with the Ticket Partner's Ticket Purchase Terms.
Complaints may be submitted in writing to the Organiser's correspondence address: CLOUT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Rynek 6, 43-400 Cieszyn, or by e-mail to: get@clout.pl
A complaint submission should contain the complainant's first and last name, correspondence address, order number, as well as an indication of the grounds for the complaint and the content of the demand. Incomplete provision of information necessary to respond to the complaint may result in difficulty providing such a response or in it being impossible to provide.
Before a complaint submission is considered, the Festival Attendee may be asked to present proof of purchase of the Ticket to which the complaint relates.
The Festival Attendee acknowledges and accepts that, given the nature of the Festival, and in particular the number and diversity of the events planned, the Festival programme may change for reasons beyond the Organiser's control.
The Organiser shall resolve a complaint within 14 days of the date it is submitted to the Organiser.
The controller of personal data provided in connection with the complaint procedure is the Organiser. The data are processed in accordance with the Privacy Policy.
Out-of-Court Methods of Dispute Resolution
In the event of a dispute arising between a Festival Attendee and the Organiser, the Festival Attendee has the option of using out-of-court methods of handling complaints and pursuing claims.
To this end, a Festival Attendee who is a consumer may, in particular, seek assistance from consumer organisations and municipal or district consumer ombudsmen. A link to a search engine for consumer support institutions is available on the website of the Office of Competition and Consumer Protection (UOKiK): UOKiK — Consumers — Consumer Institutions — Institution Search Engine.
The Festival Attendee may also use the online dispute resolution (ODR) platform available at: http://ec.europa.eu/consumers/odr.
